1. Introduction
a. These terms and conditions cover all aspects of the Smile Tutors.co.uk website.
b. A ‘user’ can be defined as any person viewing or submitting data on Smile Tutors.co.uk. A ‘user’ can be divided in two categories a ‘tutor’ and a ‘tutee’.
c. Any users must adhere to these conditions for the duration of his or her association with Smile Tutors.co.uk.
d. The ‘tutor’ is anyone offering an educational service and receiving reward.
e. The ‘tutee’ is the person receiving an educational service. Should you be acting on the behalf of another, for instance a minor, you are still to be considered the tutee.
f. Smile Tutors reserve the right to modify and improve the Terms and Conditions without notice.
2. Tutor Obligations
a. Deemed to have agreed in registering
b. Neither the director of Smile Tutors.co.uk, nor any of its permanent staff are liable for any loss, damage or injury caused while tutoring a client.
c. The tutors supplied by Smile Tutors.co.uk are self-employed with respect to paying their own tax, national insurance and any other duties payable.
d. If a tutee has contacted the tutor via Smile Tutors.co.uk and then receives a tuition service from the tutor, the tutor is required to pay the sum of (£20) to Smile Tutors. Once the connection has been made this charge stands indefinitely.
e. If no lesson is given the tutor is not required to pay.
f. The data tutors submit must be accurate and not misleading in any way. It is the tutor’s responsibility to keep information up-to-date. Tutors are not permitted to share tutee information with any other third party and must not be negligent with the data they receive. All data is governed by our Privacy Policy.
g. The tutor must also adhere to the Teaching Environment Obligations described below.
h. Failure to meet all these criteria would be considered a breach of Terms and Conditions (see below).
3. Tutee Obligations
a. The tutee is deemed to have agreed to these terms by submitting their information to our tutors
b. The data tutees submit must be accurate and not misleading in any way. It must also not be of an offensive nature as detailed in the breach of contract.
c. Tutees must adhere to the Tutoring Environment Obligation
4. Tutoring Environment Obligations
a. Tutors must respond to any contact sent from a tutee.
b. All lessons must be prepared and structured well in advance.
c. Tutors must deal with queries from clients in a helpful and professional manner at all times. When clients leave message/s for the tutor via email or telephone, the tutor MUST reply as soon as possible, even if that is to say they are not available for tuition.
d. All tutors must timetable an extra fifteen (15) minutes with the first lesson in order to discuss pupil needs, tuition arrangements and tuition fees. As a matter of courtesy to clients, we ask that tutors do not charge for this extra time.
e. Tutors must ensure they are sufficiently resourced and appropriately dressed. We recommend that tutors dress smart for every lesson.
f. Tutors must arrive to lessons on time. We recommend that you arrive five (5) minutes early, and leave on time. If tutors anticipate they are going to be more than fifteen (15) minutes late, then they must inform the client prior to making the journey or when suitable during the journey. The period of time late must be made up at the end of the lesson or at another date.
5. Legal Agreements
a. I will ensure that I carry myself in a professional manner at all times whilst providing tuition to a client.
b. I shall ensure an adult is present for the entire duration of the lesson, when tutoring a minor (aged under 18).
c. I certify that I do NOT have a criminal record. [All CRC checks (police check) must not be more than three years old].
d. I certify that all registration details provided are accurate and up to date. I will ensure that registration details are updated regularly or as-and-when they change.
6. Breach of Terms and Condition
a. Any discrepancy from these Terms and Conditions is considered a breach and can and will be acted upon in the following manner.
b. In most cases we may issue a written warning which if breached a further time will result in immediate removal from the site.
c. We reserve the right to remove your data and ban you from the site should any breech occur without notice.
d. With regards to the Legal Agreements in particular any breech may result in Police involvement and we reserve the right to pass your details to the Police at any time without notice.
